Riders hurt in two spills at the Park

first_imgThree jockeys sustained injuries and had to be rushed to hospital in two separate races, the sixth and seventh, respectively, at Caymanas Park yesterday.Coming out worst was three-time champion Dane Nelson, whose mount, MONTEGONIAN, stumbled and fell approaching the furlong pole in the sixth race over 1300 metres, decking the popular jockey. In the ensuing melee, STRAIGHTFROMUHEART was brought down, throwing jockey Richard Mitchell as well. The horse also stepped on Nelson, who lay motionless on the ground for a while before he was rushed to the First Aid Post in the track ambulance.Nelson regained consciousness shortly after, but was then fitted with a neck brace by the paramedics and taken to the University Hospital of the West Indies (UHWI) for treatment and further observation.Mitchell, on the other hand, escaped injury, but did not ride for the remainder of the day.In the very next race over 1500 metres, won by 7-2 chance DREAMCOMETRUE, both DINNER BY SEVEN and STIR IT UP dislodged their respective riders, Paul ‘Country’ Francis and the veteran Vassell ‘Jollyman’ Najair in the backstretch.Francis is suspected to have fractured his collar bone, while the 62-year-old Najair was badly shaken up and received an injury to his face. Both were taken to the UHWI for observation.SEVERAL SPILLSAlthough there have been several spills on racedays at Caymanas, only one has claimed the life of a jockey in 56 years of racing at the track. This occurred on November 20, 1999, when popular lightweight jockey, Al Gopie, was thrown by his mount, SAGAR, at the half mile and was trampled by horses in the day’s penultimate race.Meanwhile, firm favourites ROYAL ASSAULT and ETERNAL JOY led from start to finish to win the co-feature races on the card.Ridden by champion jockey Shane Ellis for trainer Anthony ‘Baba’ Nunes, the much-improved 4-y-o colt, ROYAL ASSAULT, romped the overnight allowance sprint as the 3-5 favourite. And 30 minutes later, the Neive Graham-trained ETERNAL JOY, a 2-1 favourite, with apprentice Linton Steadman replacing the injured Paul Francis, did likewise in the closing race over 1200 metres for the Colin Melhado Memorial Cup (claiming $250,000-$210,000).last_img read more

Freedman vows to change culture

The naivety has formed as a culture and that will change in the summer. Analysis:  The Dover Decision

first_imgDr. Kevin L. Anderson of the Creation Research Society wrote an analysis of Judge Jones’ decision in the Kitzmiller v. Dover School District case.  Since this appeared in a members-only newsletter, Creation Matters, we sought and obtained permission to reproduce it: Click Here.    A very different view was expressed by David Johns (School of Government, Portland State U) in a letter to Science this week (10 March 2006: Vol. 311. no. 5766, p. 1376):There is no question that the court decision in the Dover case was a good one.  The opinion written by Judge Jones is rigorous and thorough—and yes, quite elegant.  There is a substantial dark side to this decision, however, that reflects poorly on the scientific community.  How did it come to this court fight?  How, in a country as “developed” as the United States, have the school system, the media, and the scientific community failed so miserably to educate the majority of Americans about the nature of science in general and evolution in particular?  Too often, scientists do not take their public role seriously enough.  If scientists do not respond aggressively to the need to bring the rest of society along and confine themselves to talking to each other, the scientific enterprise [sic] will likely find itself uncomfortably out on a limb.  Should the United States continue to drift closer to the world’s theocracies and away from the preferable if very flawed secular democracies, science and scientists will suffer.Since Science never prints any letters in favor of intelligent design, and has expressed similar statements in its editorials, this can probably be said to represent the feelings of the editors.  Readers are encouraged to compare and contrast the views (and logic) of Johns and Anderson – and then, consider the analysis of the Dover decision by one of the leading philosophers in the world today, Alvin Plantinga, posted on Science & Theology News this week.Johns repeats the usual canards and non-sequiturs of the Darwin Party: viz., if students don’t get Sola Darwina crammed down their throats, then they won’t be able to compete in the global economy (see 02/28/2006 entry) and our atheist utopia will degenerate into a society of ignorant AK47-toting fundamentalists.    Since many other states and school boards are rethinking their positions in the aftermath of the Dover case, it is essential to understand the Dover decision and its many flaws.  In Dr. Anderson’s incisive critique of the decision, he unmasked its inconsistencies and logical fallacies in an easily readable, medium-length article.  Lawyers and educators should take note of the ways Dr. Anderson has argued that the decision can be turned against dogmatic evolutionism itself.  This is an article to pass around.(Visited 18 times, 1 visits today)FacebookTwitterPinterestSave分享0last_img read more

The importance of documenting loan receivables from a tax perspective

RavencraftIf you have ever purchased a farm, a house, a tractor, or any other item that required financing, you know that there are many documents that must be signed when financing a purchase. Chances are you have signed documents with all kinds of terms related to principal amounts, interest rates, due dates and penalties. Although reading these documents can be somewhat terrifying, especially when reading the penalty provisions, these documents serve a purpose.For farming businesses that make loans to other family member or customers, these documents are the legal proof that establishes that they are entitled to money and how they are to be repaid. When a business goes to court to get a judgment against someone who has not paid them, they are expected to produce those documents to prove that they are owed money from a specific person. And the truth is we would not have it any other way. Fairness demands that if a business is demanding someone to pay them, they need to have written proof of it.Farming businesses, big and small, also need these documents to prove to their accountants and to the IRS the existence of those loans for tax purposes. There are times when businesses may feel that there is no need for these documents because it’s an inconvenience or they know the party that they are lending to. This is a big mistake. Recently, in the case of John M. Sensenig, et ux. v. Commissioner, TC Memo 2017-1, Code Sec(s) 166; 385; 6662; 7491, the tax court found that lack of documentation of loans was a major factor in the denial of bad debt loss deductions by a taxpayer. As a result, not only did the taxpayer lose major deductions for bad debt losses due to the lack of documentation, but the taxpayer incurred significant accuracy-related penalties as well.Just as a court would demand those documents in order for a farming business to be able to obtain a judgment against someone who owed them money, a tax court and the IRS will demand to see those same documents to prove that they are entitled to claim a bad debt loss deduction. Another wrinkle in the Sensenig case was that the loans made in that case were made between businesses that had common ownership. Due to the common ownership and the lack of formal documentation of the loans (among other things), those loans were not only not allowed to be claimed as bad debt losses but were treated as equity by the tax court, which has further significant accounting and tax consequences (not to mention headaches).Loans that are made to shareholders, members or other related businesses receive a high level of scrutiny from the IRS and tax courts. Not only does documentation play a major role in determining whether the loan should be treated as a loan or as an equity contribution, but so do things such as creditworthiness, relationship of the lender and debtor, attempts to collect the debt if delinquent, capital structure of the debtor, and other factors related terms of the repayment of the loan.Documentation of a loan is a critical first step in establishing that a loan should be treated as loan and nothing else such as a gift or equity.At Holbrook & Manter CPAs, we can help guide you and your business through the steps to effectively document and preserve any loan interests you and your farming business may have. Brian E. Have Chromecast, Will Travel … Er, Maybe Not

first_imgadriana lee Using a hotel Internet access point can sometimes be like stepping up to a bouncer at a fight club: You must give a password to gain access, agree to certain terms or even both. If there are entrance requirements you fail to meet, you’ll get bounced out before you can really get your hands dirty. This authentication goes beyond the initial WEP or WPA login, which is sometimes required when you first hop on a hotel Wi-Fi network. It may appear in a new browser window or standalone pop-up, asking for a passcode, payment or to click a button to accept the terms of service. On a mobile device or laptop, it’s easy to take care of that. But Chromecast doesn’t offer a Web browser of its own, and there’s no direct way to type in a code or click a button. So it connects to open networks just fine, but it’s just not designed for this kind of authentication. On the Google support page, the company clearly states that “Chromecast only works with networks which allow device to device communication.” This is crucial. The device uses your phone, tablet or laptop as the direct input mechanism that tells it what network to join and the password for that network. In other words, Chromecast fundamentally depends on the devices’ ability to connect directly to each other. See also: 10 Things You Need To Know About ChromecastHowever, most hotels and other public Wi-Fi networks—like those at schools, cafes and other hotspots—go out of their way to block that using “AP/Client isolation.” This essentially stops devices on a single network from communicating with each other to thwart hacking attempts or undue network congestion, but it also has the unintended effect of slamming the door closed on Chromecast sessions. Not that hotels would mind this. The hospitality industry has seen revenue decline from its pay-per-view channels for years, so it’s not likely shedding any tears over guests’ inability to stream content using their wireless network. Getting Hotel Wi-Fi To Fly On ChromecastSee also: What You Can Watch On Chromecast, And HowNot that it’s impossible to get streaming to your hotel TV using the Chromecast. But it does require some planning, possibly some extra expense and/or a little luck: •  Hardwired hotel Internet connections via ethernet are dying out, but some holdovers still offer them. If you’re fortunate enough to encounter one, you might be able to use your laptop and share that Internet connection, effectively turning it into a hotspot that your Chromecast can join. See also: How Google’s Chromecast Lets Down iPhone Users•  If you have a hard ethernet connection that doesn’t force a login, you might consider traveling with an AirPort Express Base Station or another travel router. In some cases, this may be able to broadcast a wireless signal that any of your mobile devices can share, including the Chromecast. •  Laptops with later versions of Windows (7+) can use Connectify, a program that allows computers to act as wireless routers—whether the initial connection comes via wireless or ethernet. (Paid users can also share 3G/4G.) In this scenario, the laptop joins the hotel’s Internet—somehow—and then creates its own wireless network that the Chromecast joins. The software doesn’t support Macs, however, which have their own built-in Internet Sharing feature. Unfortunately, it’s limited. They can share an ethernet connection over wireless, or Wi-Fi signal over Bluetooth, but they can’t share Wi-Fi back out over Wi-Fi to other devices. (Then again, you never know—perhaps Google will actually do something with that mysterious Bluetooth hardware in the Chromecast.)•  If you have a MiFi or mobile hotspot feature on your smartphone/tablet, you could forget the hotel’s network completely and use cellular instead. However, bear in mind that coverage can vary, and if you don’t get strong reception, the video quality can suffer. A lot. (Oh, and be sure to mind those data caps.) Of course, if none of these options work for you, there’s one more possibility: foregoing the Chromecast altogether. If you’re alone in the hotel room, streaming right onto the smaller screen of your phone, tablet or laptop would be the simplest solution. And if you’re not, actual physical cables could make easy work of playing content from your phone or tablet to the TV. I paired this one from Scosche and my previous 30-pin iPad for months, and it always worked flawlessly. See also: 5 Cool Chromecast Hacks And WorkaroundsThe upside is that you don’t have to be relegated to a pokey-slow hotel network and the insufferable buffering such connections cause. And although it’s not a sexy solution, it’s far more elegant than banging your head against that flimsy hotel drywall, trying to get the portable streaming dongle to actually do what it was born to do—function away from home. If there’s one piece of good news, it’s that the Chromecast is updateable over the air, so Google could address this issue in a future software patch. After all, it highly emphasized the go-anywhere nature of these streaming sticks, so hopefully it won’t be long before we get to take our shows on the road.
